Terms of Service

By accessing or using Otterneti ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Platform.

These terms apply to all users of the Platform, including clients who purchase services, service providers who offer services, and organization administrators who manage teams. Your continued use of Otterneti after any changes to these terms constitutes your acceptance of those changes.

Otterneti is a SaaS platform that provides tools for service professionals to manage their business, deliver services, and get paid. Service providers can list their services, manage orders, deliver work, and receive payments. Clients can browse services, place orders, and manage projects. Organizations can create teams to collaborate on service delivery.

Otterneti provides the technology and infrastructure for professionals to run their service businesses. We are not a party to the agreements between providers and their clients. Otterneti acts as a SaaS platform provider, not as an employer, agent, or contractor.

To use most features of Otterneti, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you suspect unauthorized access, notify us immediately at hello@otterneti.com.

You must be at least 18 years of age to create an account. Otterneti reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

All payments on Otterneti are processed through Stripe, our third-party payment processor. By making or receiving payments on the Platform, you agree to Stripe's terms of service in addition to ours.

Otterneti charges a commission on each completed order. The commission rate varies by subscription plan: 5% on the Free plan, 3% on Starter, 2% on Pro, and 1% on Agency. These rates are deducted from the service provider's earnings before payout.

Service provider earnings are held for 14 days after an order is marked as completed before they become available for withdrawal. This hold period exists to protect clients and allow time for dispute resolution. Withdrawals are subject to a 2.5% platform processing fee. All prices displayed on the Platform are in US dollars unless otherwise stated.

As a user of Otterneti, you agree not to: misrepresent your identity or qualifications, engage in fraudulent or deceptive conduct, harass or threaten other users, circumvent the Platform's payment system, or use the Platform for any illegal purpose.

Service providers are responsible for delivering services as described in their listings and within the agreed-upon timelines. Clients are responsible for providing clear requirements and timely feedback. Both parties are expected to communicate respectfully and professionally.

You are responsible for any content you post, including service listings, reviews, messages, and deliverables. Content must not infringe on third-party intellectual property rights or violate any applicable laws.

Upon full payment for a completed order, the intellectual property rights for the delivered work transfer from the service provider to the client, unless otherwise agreed upon in the service listing or a separate written agreement between the parties.

The Otterneti name, logo, and all related trademarks, service marks, and branding are the property of Otterneti. You may not use our branding without prior written permission. The Platform itself, including its software, design, and documentation, is protected by copyright and other intellectual property laws.

Otterneti provides the Platform on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the Platform. We do not guarantee that the Platform will be uninterrupted or error-free.

To the maximum extent permitted by law, Otterneti shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claim shall not exceed the amount you paid to Otterneti in the 12 months preceding the claim.

Otterneti is not responsible for the quality, safety, or legality of services offered by service providers, or the ability of clients to pay for services. Disputes between clients and service providers should be resolved through our dispute resolution process.

You may close your account at any time by contacting our support team. Upon account closure, any pending orders must be completed or cancelled, and any remaining earnings will be processed according to our standard payout schedule.

Otterneti reserves the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if we reasonably believe your continued use poses a risk to other users or the Platform. We will provide notice when possible, but may act immediately in cases of severe violations.

We may update these Terms of Service from time to time. When we make material changes, we will notify you by email or through a notice on the Platform at least 30 days before the changes take effect.

Your continued use of Otterneti after the effective date of any changes constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you should stop using the Platform and close your account.
